Terms and Conditions

All parties using the Giftaway systems agree to be bound by the following contract terms and conditions. When you purchase or redeem a Giftaway Certificate or are a provider, you agree to be legally bound by the terms and conditions as set out below. Please do not purchase a Certificate or become a provider until you have read, understood and agree to be bound by these terms and conditions.

1. There is no GST on the face value of the Giftaway Certificate.

GST is incurred on the product or service the certificate is redeemed wholly or in part for.

2. Not Redeemable for Cash

Giftaway Certificates are not redeemable for cash wholly or in part, either from Giftaway or any provider of a good or service.

3. Transferable

Giftaway Certificates are fully transferable until redeemed. Please keep your certificate number secure.

4. Expiry Date

Giftaway Certificates expire 12 months from the date of purchase (not the date the voucher is given to a third person). After this date they expire and cannot be recovered and their value is lost. Please ensure you redeem the Certificate before the expiry date.

5. Unused Value of Certificate

The full amount must be redeemed against one experience/operator. The Certificate is not redeemable for cash in whole or part, either from Giftaway or the operator. Many operators offer additional services such as massage, tours, dining etc., which will enhance your experience.

6. Delivery by Email

We deliver Giftaway Certificates by email. Make sure that your email program is not blocking the Certificate as spam. Giftaway is not liable for the non-delivery of a Certificate.

7. Booking in Advance

Bearers of Giftaway Certificates agree that booking must be made in advance and using the booking facility on www.giftaway.com.au. Any attempt at redemption other than in accordance with this requirement will result in the certificate being refused.

8. Complaints

Giftaway acts as payment facility for the provider of goods or services promoted. Any complaint should be taken to the provider concerned in the first instance. However, we guarantee to mediate between the bearer of the certificate and the provider where both parties agree in order to reach a mutually agreeable resolution of any dispute.

9. Redemption of Certificate

The Provider agrees that the Certificate value, less commission plus GST, can only be claimed through the form on www.giftaway.com.au

10. Accuracy and Honesty

Providers must provide accurate details of the good or service being offered to Giftaway.com.au and advise Giftaway of any changes immediately. Providers agree to abide by all laws and regulations governing the description or goods or services being offered and indemnify Getawaygifts, its agents and servants against any breach whatsoever.
